1. Acceptance of Terms

By downloading, installing, or using Nomfly ("the App"), operated by Tapwise Digital LLC ("we," "us," or "our"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

Nomfly is an AI-powered meal decision app that uses artificial intelligence to suggest meals based on your preferences, dietary restrictions, available ingredients, and mood. The App includes recipe browsing, grocery list management, restaurant discovery, nutrition tracking, and household meal coordination.

3. AI-Enhanced Features

Nomfly uses AI to enhance parts of the experience. We are transparent about what is and isn't AI-generated:

What IS AI-Enhanced

• Meal suggestions & ranking: Decide picks and mood/meal-type recommendations are generated by large language models
• Food images: Recipe card photos are AI-generated when no source photo is available
• Metadata tagging: Cuisine, category, difficulty, style tags (e.g., Quick, Comfort Food), mood hints, and dietary labels on user-submitted public recipes are assigned by AI and may be imperfect
• Nutritional values: Calories, protein, carbs, fat, fiber, and sodium are estimates computed either by AI (Claude) based on ingredient quantities, or derived from USDA FoodData Central lookups with regex-parsed ingredient matching — not lab tests. Actual values vary with preparation, brand, and portion size and may be off by 20–40% in either direction.
• Recipe quality screening: User-submitted public recipes are AI-audited for spam/non-food content before publishing

What is NOT AI-Altered

• Ingredients lists, cooking steps, prep/cook times, and serving sizes are stored as provided by the original recipe source (catalog import, URL extraction, or direct user submission). Nomfly does not rewrite, substitute, or generate these fields with AI.

Limitations You Accept by Using Nomfly

• Not medical or nutritional advice: Nomfly does not provide medical, nutritional, or dietary counseling. Consult a qualified healthcare professional or registered dietitian for specific dietary needs, allergies, medical conditions, pregnancy, or health goals.
• Not FDA-evaluated: Nutritional estimates have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease.
• Not a substitute for professional guidance: If you have severe food allergies, metabolic conditions (including diabetes), kidney/liver disease, heart conditions, or other health concerns, do not rely solely on Nomfly's suggestions or nutrition estimates.

3b. Allergens & Dietary Restrictions

You are responsible for verifying every ingredient for allergens and dietary compatibility before cooking or eating. Nomfly's dietary filters (vegan, vegetarian, gluten-free, dairy-free, nut-free, keto, pescatarian) work by pattern-matching ingredient text and are best-effort only. Filters may:

• Miss hidden allergen sources (e.g., honey in "vegan" marked recipes, trace gluten in sauces)
• Miss ingredient substitutions written in non-standard ways
• Surface recipes with unlisted cross-contact ingredients

If you have a life-threatening allergy, do not rely on app filters. Read every ingredient and verify with the original recipe source when in doubt.

3c. Food Safety

You are responsible for safe food handling and preparation. Cooking times, temperatures, and instructions in Nomfly are guidelines only. Always:

• Cook meat, poultry, seafood, and eggs to safe internal temperatures recommended by the USDA or equivalent food safety authority in your region
• Follow safe storage, thawing, and reheating practices
• Discard recipes that appear undercooked, unsanitary, or mismatched from the stated description
• Consider your kitchen equipment, altitude, and ingredient freshness — AI-suggested times may not account for these

4. User Accounts

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to use the App
• One account per person; do not share account credentials

5. Subscriptions & Payments

Free Tier

• 7-day complimentary Pro access for eligible new accounts (no credit card required)
• After trial: 3 meal decisions per day, 6 recipe views per day, basic features

Nomfly Pro

• $5.99/month or $49.99/year
• Unlimited decisions, full browse access, ingredient scan, household profiles, nutrition dashboard, smart meal plans
• Subscription auto-renews unless canceled at least 24 hours before the end of the current period
• Cancel anytime via Apple's subscription management (Settings > Apple ID > Subscriptions) or Google Play subscriptions
• No refunds for partial billing periods

Payment Processing

• All payments processed through Apple's In-App Purchase system or Google Play Billing
• We do not collect or store payment information directly

6. User-Submitted Content

• You retain ownership of recipes, photos, and other content you submit
• By submitting content, you grant Nomfly a non-exclusive, worldwide, royalty-free license to display, distribute, and use the content within the App
• You must not submit content that is illegal, harmful, or infringes on others' intellectual property
• We reserve the right to remove user-submitted content that violates these terms

7. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Attempt to reverse-engineer, decompile, or access the App's source code
• Scrape, harvest, or extract recipe data from the App
• Create fake accounts or abuse the free trial system
• Interfere with the App's infrastructure or other users' experience
• Use the App to generate content for competing services

8. Intellectual Property

• The Nomfly name, logo, and brand assets are our trademarks
• Recipe database content sourced from public recipes and AI generation
• AI-generated food images are created for the App and may not be used commercially outside the App

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOMFLY, TAPWISE DIGITAL LLC, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Allergic reactions, anaphylaxis, or intolerance responses from ingredients in any recipe surfaced, suggested, or filtered by the App
• Foodborne illness, injury, or harm resulting from meal preparation, cooking temperatures, storage, or handling
• Health outcomes (including but not limited to weight change, blood sugar fluctuations, nutritional deficiencies, or condition exacerbation) associated with following AI-generated nutrition estimates or meal suggestions
• Inaccurate or imprecise nutritional information, calorie counts, macronutrient values, or dietary labels
• AI-generated content errors, including mis-categorized recipes, mis-tagged dietary compatibility, or mismatched food images
• Decisions made in reliance on Decide suggestions, mood rankings, or ingredient-based recommendations
• Service interruptions, data loss, unauthorized access to account data, or security incidents

YOU ACKNOWLEDGE THAT THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOUR USE OF THE APP AND RELIANCE ON ANY AI-GENERATED OR USER-SUBMITTED CONTENT IS AT YOUR SOLE RISK.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time via Profile > Privacy & Data > Delete Account.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via in-app notification. Continued use after changes constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the State of North Carolina, United States.
